General Conditions of Sale (GCS)

These conditions of sale are concluded between:
- The company Chimball , whose head office is located at 39 Rue de Plaisance, 75014 Paris, registered in the Trade and Companies Register under number [RCS Number], operating the site chimball.com and hereinafter referred to as “ Chimball ” or “the Seller”,
And
- Any natural or legal person wishing to make a purchase via the chimball.com website, hereinafter referred to as “ the Buyer ”.
Article 1: Purpose
These General Terms and Conditions of Sale define the contractual relations between Chimball and the Buyer as well as the conditions applicable to any purchase made on the chimball.com website. Any order implies the unreserved acceptance of these General Terms and Conditions by the Buyer, who acknowledges having read them before ordering.
Chimball reserves the right to modify these conditions at any time. The applicable conditions are those in force at the time of the order.
Article 2: Products
The products offered for sale are authentic South American football jerseys available on the chimball.com website, while stocks last.
Each product is presented with a detailed description and representative photographs. However, slight differences may exist due to screen display settings.
Article 3: Rates
Product prices are indicated in euros (€), all taxes included (TTC), excluding delivery costs. Delivery costs are calculated when the order is validated.
Chimball reserves the right to modify its prices at any time. The applicable price is the one in effect at the time of validation of the order.
Article 4: Order and Payment Terms
Order
To place an order, the Buyer must:
- Add products to cart.
- Validate the basket after verification.
- Create an account or log in to your existing account.
- Enter your delivery and billing information.
- Accept these T&Cs.
- Choose the payment method and confirm the order.
The order is validated after receipt of payment and confirmed by a summary email.
Payment
The accepted payment methods are:
- Bank card (Visa, Mastercard, etc.)
- PayPal
Payment is secured using the SSL protocol.
Article 5: Reservation of Title
Chimball retains ownership of the products until full payment of the price by the Buyer.
Article 6: Delivery
The products are delivered to the address indicated by the Buyer when ordering. Delivery times vary between 3 and 7 working days depending on the destination.
Delivery costs are specified before the order is confirmed. In the event of a delay in delivery beyond the control of the Seller (force majeure, strike, etc.), Chimball cannot be held liable.
Article 7: Right of Withdrawal
In accordance with article L221-18 of the Consumer Code , the Buyer has a period of 14 days from receipt of the product to exercise his right of withdrawal without justification.
To return the product, the Buyer must contact Chimball at chimballfr@gmail.com. Return shipping costs are the responsibility of the Buyer.
Article 8: Warranty
The products benefit from legal guarantees of conformity and against hidden defects in accordance with articles L217-4 to L217-14 of the Consumer Code and 1641 to 1649 of the Civil Code .
In the event of a defective product, the Buyer may request an exchange or refund.
Article 9: Liability
Chimball cannot be held responsible for damages resulting from improper use of the product purchased or disruptions linked to the use of the Internet network.
Article 10: Data Protection
The personal information collected is used only for order processing and customer relations. In accordance with the GDPR , the Buyer has the right to access, modify and delete data concerning him. To exercise these rights, he can contact chimballfr@gmail.com .
Article 11: Intellectual Property
All contents of the chimball.com website (texts, images, logos, etc.) are the exclusive property of Chimball . Any unauthorized reproduction is strictly prohibited.
Article 12: Disputes
These General Terms and Conditions are subject to French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing this, the dispute will be submitted to the competent courts of the Chimball head office.
