Terms of sale

The present conditions of sale are concluded between :

The company Chimball, whose registered office is located at 39 Rue de Plaisance, 75014 Paris, registered with the Registre du Commerce et des Sociétés under the number [Numéro RCS], operating the chimball.com site and hereinafter referred to as “Chimball” or “the Seller”,
and

Any individual or legal entity wishing to make a purchase via the chimball.com site, hereinafter referred to as “the Buyer”.
Article 1: Purpose
These General Terms and Conditions of Sale define the contractual relationship between Chimball and the Buyer, as well as the conditions applicable to any purchase made on the chimball.com website. All orders imply the Buyer's unreserved acceptance of the present Terms and Conditions of Sale, and the Buyer acknowledges having read them prior to placing an order.

Chimball reserves the right to modify these conditions at any time. The applicable conditions are those in effect at the time of the order.

Article 2: Products
The products offered for sale are authentic South American soccer shirts available on the chimball.com website, within the limits of available stocks.

Each product is presented with a detailed description and representative photographs. However, slight differences may exist due to screen display settings.

Article 3: Prices
Product prices are quoted in euros (€), inclusive of all taxes (TTC), excluding delivery charges. Delivery costs are calculated when the order is validated.

Chimball reserves the right to modify its prices at any time. The applicable price is the one in effect at the time the order is validated.

Article 4: Ordering and Payment Methods
Ordering
To place an order, the Buyer must :

Add products to the basket.
Validate the basket after checking.
Create an account or connect to an existing account.
Enter delivery and billing information.
Accept these terms and conditions.
Choose payment method and confirm order.
The order is validated once payment has been received and confirmed by a summary e-mail.

Payment
Accepted payment methods are :

Credit card (Visa, Mastercard, etc.)
PayPal
Payment is secured by SSL protocol.

Article 5: Retention of title
Chimball retains title to the products until full payment has been received from the Buyer.

Article 6: Delivery
Products are delivered to the address indicated by the Buyer at the time of ordering. Delivery times vary between 3 and 7 working days, depending on the destination.

Delivery charges are specified before the order is confirmed. Chimball cannot be held responsible for delays in delivery beyond the Seller's control (force majeure, strikes, etc.).

Article 7: Right of Withdrawal
In accordance with article L221-18 of the French Consumer Code, the Buyer has a period of 14 days from receipt of the product to exercise his/her right of withdrawal without justification.

To return the product, the Buyer must contact Chimball at chimballfr@gmail.com . The Buyer is responsible for return shipping costs.

Article 8: Warranty
The products benefit from the legal warranties of conformity and against hidden defects in accordance with articles L217-4 to L217-14 of the French Consumer Code and 1641 to 1649 of the French Civil Code.

In the event of a defective product, the Buyer may request an exchange or refund.

Article 9: Responsibility
Chimball cannot be held responsible for damages resulting from misuse of the purchased product or disturbances linked to the use of the Internet network.

Article 10: Data Protection
The personal information collected is used solely for order processing and customer relations. In accordance with the RGPD, the Buyer has the right to access, modify and delete data concerning him/her. To exercise these rights, he/she may contact chimballfr@gmail.com .

Article 11: Intellectual Property
All contents of the chimball.com site (texts, images, logos, etc.) are the exclusive property of Chimball. Any unauthorized reproduction is strictly prohibited.

Article 12: Disputes
The present terms and conditions are subject to French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing this, the dispute will be submitted to the competent courts of Chimball's head office.
